1. Key Terms, Scope, and Our Terms of Service
Key Terms
"Apps": Our mobile applications, including those distributed via the Apple App Store and the Google Play Store.
Capitalized terms not defined here have the meaning given to them in the Moya Terms of Service.
When this Privacy Policy applies
This Privacy Policy describes the types of information we may collect from you when you visit or use our Platform or any of its components, and when we communicate with you electronically, such as through our Platform, email, text message, and other electronic messages between Moya and you.
When this Privacy Policy does not apply
This Privacy Policy does not apply to information:
(a) we collect through any in-person or face-to-face interactions, or through audio-only telephone conversations;
Our Terms of Service
This Privacy Policy is incorporated into and governed by our Terms of Service at https://heymoya.ai/terms-of-service, which also apply when you use our Platform.
2. Information We Collect
Information you provide to us
You may provide Personal Information and other information to us through our Platform, including:
Account information. When you register, you provide information such as your name, email address, and password, or you may authenticate through a third-party login such as Google. You must be at least 18 years old to register (see Section 9).
Information we collect automatically as you use the Platform
We collect information about the computers, devices, browsers, and internet activity you use to interact with our Platform, including unique identifiers, browser type and settings, device type and settings, operating system, mobile network information (including carrier name), and application version number.
We also collect information about how your apps, browsers, and devices interact with our Services, including IP address, device type, crash reports, traffic data, log file information, system activity, and the date, time, and referrer URL of your requests.
Online activity
We collect information about your activity on our Platform and your online activity, such as browsing history, search history within the Platform, and information about how you interact with our Platform and the Stories and Characters available on it. We use technologies such as cookies, pixels or pixel tags, local storage, databases, and server logs to collect and store this information.
3. Interactive Sessions, Content, and AI
Because Moya is an interactive, chat-based platform, the content of your interactive sessions is central to how the Service works. This section explains how we handle it.
What we collect. When you play a Story or interact with a Character, we collect your Player Inputs (the choices, selections, and text you submit) and the resulting System Output, and we retain the complete record of the session (the "Transcript"), including the sequence and combination of Player Inputs and System Output. When you act as a Creator, we collect and store the Creator Content you submit.
4. How We Use Your Information
We use your Personal Information to:
Provide, operate, maintain, supervise, administer, improve, and enhance our Platform, Services, features, and functionality.
Create and maintain your account and authenticate you.
Process your purchases, transactions, and payments, and prevent transactional fraud.
Communicate with you, including sending service-related messages and, where permitted, marketing messages.
Provide support and respond to your inquiries.
Develop, train, evaluate, and improve our artificial intelligence models, features, and systems, as described in Section 3.
Maintain the safety, integrity, and security of our Platform, including detecting, preventing, investigating, and responding to fraud, abuse, security risks, policy violations, and technical issues.
Conduct internal testing, research, analysis, and product development.
Carry out our legal and contractual obligations and enforce our rights, including our Terms of Service.
Comply with applicable law, regulation, legal process, or enforceable governmental request, and respond to law enforcement requests, court orders, and subpoenas.
Facilitate a merger, divestiture, restructuring, or other business transfer.
For any other purpose with your consent.
We do not use your information for interest-based or targeted advertising, and we do not share your information with advertising networks for that purpose.
5. How We Share Your Information
We share Personal Information with third parties in the following circumstances:
Service providers. With affiliates, vendors, service providers, and business partners that help us operate and maintain the Platform, such as cloud hosting and storage, analytics, AI infrastructure and model providers, customer support, payment processing, content moderation, and security.
We do not sell your Personal Information for money, and we do not share your Personal Information for cross-context behavioral or targeted advertising.
6. Your Choices and Privacy Rights
Cookies
You can change cookie settings through your browser, including blocking some or all cookies. If you block all cookies, including strictly necessary cookies, you may not be able to access or use certain areas or features of our Platform.
Marketing communications
If you do not wish to receive marketing emails from us, you can opt out at any time by clicking the unsubscribe link at the bottom of any marketing email. We may still send you service-related communications.
Access, correction, and deletion
In addition to any controls available within the Platform, you may contact us at hello@claythis.com to ask questions about, request access to, request correction of, or request deletion of your Personal Information.
We may be unable to accommodate a request if we believe it would violate any law or legal requirement, or cause the information to be inaccurate. We may take reasonable steps to verify your identity before acting on a request.
U.S. state privacy rights
Depending on where you live, you may have rights under state privacy laws (such as the California Consumer Privacy Act, as amended) to know what Personal Information we collect, use, and share; to request access to or a copy of that information; to request correction or deletion; and to opt out of certain processing, such as targeted advertising or any "sale" or "sharing" of Personal Information.
As described in Sections 4 and 5, we do not sell or share your Personal Information for targeted advertising, so there is no advertising opt-out to exercise; the remaining rights are available to you. To exercise your rights, contact us at hello@claythis.com.
We will respond to verifiable requests within 45 days, and may extend that period once by an additional 45 days where reasonably necessary, in which case we will notify you. If we decline your request, you may appeal that decision by replying to our response or contacting us again at hello@claythis.com. We will not discriminate against you for exercising your rights.
You generally cannot opt out of our collection, use, and sharing of Personal Information to the extent necessary to provide the Platform and Services to you.
7. Data Retention
We retain Personal Information for as long as needed to provide the Platform and Services and for the purposes described in this Privacy Policy. We retain account data, such as your email, username, and password, until you delete your account. We retain Creator Content, Player Inputs, and Transcripts for as long as necessary to operate the Platform, maintain safety and security, comply with legal obligations, and support the development and improvement of our models and Services.
We may retain some data for longer periods where necessary for legitimate business or legal purposes, such as security, fraud and abuse prevention, dispute resolution, or financial record-keeping. Where we have used content or data to train AI models, information already incorporated into a trained model may not be retrievable or deletable from that model, although we will honor applicable deletion rights with respect to the underlying records we hold.
8. Data Security
We have taken steps designed to protect against the risk of accidental, intentional, unlawful, or unauthorized access, alteration, destruction, disclosure, or use of information. However, the internet is not 100% secure, and we cannot guarantee the security of information transmitted to, on, or through our Platform; any transmission is at your own risk.
Where you have chosen or been given a password, it is your responsibility to keep it confidential. We are not responsible for the circumvention of any privacy settings or security measures contained on our Platform, in your operating system, or on your device.
9. Children's and Minors' Privacy
Our Platform is intended only for adults who are at least 18 years old. We do not knowingly collect Personal Information from anyone under the age of 18. If you are under 18, do not use or provide any information on or through the Platform.
If we learn that we have collected Personal Information from a person under 18, we will take steps to delete it. If you are a parent or guardian and believe a person under 18 has provided us with Personal Information, you may contact us to request its deletion.
10. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes in our privacy practices, laws, and best practices. We will post any changes on this page and update the "Last Updated" date above.
If we make material changes to how we handle Personal Information, we will use commercially reasonable efforts to notify you, such as by email to the address associated with your account and/or through a notice on the Platform. You are responsible for keeping your account email current and for periodically reviewing this Privacy Policy.
